Terms of Use

These Terms of Use ("Terms") govern your use of Recast, including this website and the Recast note-building app (together, "Recast"). "We," "us," and "our" refer to the operator of Recast. By using or buying Recast, you agree to these Terms. If you don't agree, please don't use Recast.

1. Who Recast is for

Recast is a documentation aid for licensed speech-language pathologists, clinical fellows, SLP assistants, and SLP graduate clinicians working under supervision. You must be at least 18 years old to buy or use Recast.

2. Recast is not clinical advice

Recast helps you word and organize documentation. It does not diagnose, recommend treatment, or replace your professional judgment. Template language, goal banks, and generated sentences are drafts. You are solely responsible for reviewing, editing, and verifying everything you document, and for making sure your documentation meets the requirements of your license, employer, facility, payers (including Medicare and Medicaid), school district, and any supervising clinician. Standards and payer rules change, and we don't guarantee that any content is current or suitable for a particular setting.

3. Your data and your responsibilities

Recast is built so that the notes and client information you enter stay in your browser on your device and are not sent to us. Because of that:

• You are responsible for complying with HIPAA, FERPA, state privacy laws, and your facility's or school's policies when you use Recast.
• Use initials or codes rather than names or other direct identifiers, and use Recast only on devices you're permitted to use for this purpose.
• We can't see, recover, or back up your data. Clearing your browser data, uninstalling, or changing devices can permanently delete saved clients and templates. Always copy or export finished notes into your official record.
• The optional PIN is a privacy screen. It does not encrypt your data.

4. Your license

When you buy Recast, we grant you a personal, non-exclusive, non-transferable, revocable license to use Recast for your own professional documentation, for one clinician. You may not:

• share, resell, sublicense, or redistribute Recast, its link, or any license key or login;
• copy, scrape, or republish Recast's templates, goal banks, or other content;
• reverse engineer Recast or work around any access controls; or
• use Recast in a way that breaks the law or your professional code of ethics.

We may suspend or end your access if you break these Terms. Facilities or groups that want to buy for multiple clinicians can contact us.

5. Purchases

Recast is sold as a one-time purchase unless stated otherwise at checkout. Payments are processed by our reseller and merchant of record, which handles checkout, payment processing, and applicable sales tax; its terms also apply to your purchase. Refunds are covered by our Refund Policy.

6. Ownership

Recast, including its software, design, text, templates, logos, and the Recast name and mascot, belongs to us and is protected by copyright and other laws. The notes you write are yours.

Assessment and framework names that appear in Recast (for example MoCA, SLUMS, MMSE, WAB-R, CAPE-V, VHI-10, SSI-4, and IDDSI) are the property of their respective owners and are used only to identify them. Recast includes no test items and is not affiliated with or endorsed by those owners or by the American Speech-Language-Hearing Association (ASHA). 7. Changes and availability

We may update, improve, or change Recast, and we may update these Terms. If we make a significant change, we'll update the date above. Continuing to use Recast after changes means you accept the updated Terms. We aim to keep Recast available but don't guarantee it will always be available or error-free.

8. No warranty

To the fullest extent allowed by law, Recast is provided "as is" and "as available," without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

9. Limitation of liability

To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, denied claims, or professional or regulatory consequences arising from your use of Recast or your documentation. Our total liability for any claim relating to Recast is limited to the amount you paid for Recast. Some places don't allow these limits, so they may not fully apply to you.

10. Indemnity

You agree to defend and hold us harmless from claims arising from your documentation, your handling of client information, or your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New York, unless the law where you live requires otherwise.
